1. Introduction

Welcome to Letsbay. Our services enable peer-to-peer renting of a wide range of goods, providing a platform for users to list and rent items in a sustainable and community-focused manner. Your use of Letsbay's services, accessible via our mobile applications, is governed by these Terms and Conditions.



2. User Account Registration and Use

To use Letsbay, you must register for an account. You affirm that you are of legal age and have the legal capacity to enter into these Terms. All personal information provided during registration must be current, complete, and accurate. You are solely responsible for the activity that occurs on your account and for keeping your account password secure.



3. Listings and Rentals

By listing an item, you warrant that you have the right to rent the item and that the listing is accurate, current, and compliant with our terms and applicable laws. Renters agree to use the rented items only for their intended purposes and return them in the condition in which they were received.



3.1 Prohibited Content and User Conduct

Letsbay is a community marketplace. To ensure a safe environment, you agree not to post, list, upload, or transmit any content or items that:

Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, or tortious.

Contains hate speech, including content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual.

Promotes illegal activities, specifically including the sale or rental of weapons, drugs, hazardous materials, or counterfeit goods.

Contains nudity, sexual content, or offensive subject matter.

Enforcement: Letsbay has a zero-tolerance policy for objectionable content and abusive users. We reserve the right to immediately remove any listing or content that violates these terms and suspend or ban the account of any user found violating these guidelines without prior notice. Users can report objectionable content or abuse through the "Report" feature in the app, and we will act on such reports within 24 hours.



4. Financial Terms

Listers and renters agree to the financial terms at the time of the transaction. Letsbay facilitates these transactions through our secure payment system and charges a service fee for each transaction, detailed at the point of payment. Payments are processed and disbursed in accordance with our Payment Terms, which are subject to change.



4.1 Cancellations and Refunds

Renter Cancellation: If a Renter cancels a booking less than 24 hours before the scheduled pickup time, a cancellation fee may apply as determined by Letsbay’s cancellation policy.

Owner Cancellation: Owners are expected to honor accepted bookings. Frequent cancellations by an Owner may result in account suspension.

Disputes: All refund requests must be submitted through the Letsbay support channel within 24 hours of the rental start time.



5. Security Deposits and Liability

Security deposits may be required by listers and will be handled in accordance with the deposit terms set forth at the time of the rental. Letsbay will release or return the deposit in accordance with the agreed-upon conditions of the rental transaction.



5.1 Damage and Theft

The Renter is responsible for the Item from the moment of pickup until it is returned and confirmed by the Owner.

Minor Damage: If an item is returned with minor damage (beyond normal wear and tear), the cost of repair may be deducted from the Security Deposit.

Major Damage or Theft: If the item is lost, stolen, or damaged beyond repair while in the Renter's possession, the Renter is liable for the full replacement value of the item. If the Security Deposit is insufficient to cover the loss, the Renter agrees to pay the difference immediately upon Letsbay's determination.

Letsbay's Role: While Letsbay facilitates the transaction, we do not insure the items. Owners list items at their own risk. We recommend Owners verify Renters and take appropriate photos/videos of the item's condition before handover.



6. Legal Compliance

Users are expected to comply with all local, state, and national laws while using Letsbay. This includes, but is not limited to, laws regarding the rightful ownership and lawful exchange of goods and services.



7. Intellectual Property

The Letsbay name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Letsbay or its affiliates or licensors. You must not use such marks without the prior written permission of Letsbay.



8. Privacy and Data Protection

We take the privacy of our users seriously. Our Privacy Policy explains how we collect, use, store, and protect your data. By using Letsbay, you consent to the collection and use of your personal information as outlined in our Privacy Policy.



9. Dispute Resolution

In the event of a dispute, users should first attempt to resolve the issue amicably using Letsbay's communication tools. If resolution cannot be reached, Letsbay may, but is not obligated to, provide mediation services.



10. Limitations of Liability

Letsbay's liability to you is limited to the maximum extent permitted by law. In no event shall Letsbay be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service.



11. Indemnification

You agree to defend, indemnify, and hold harmless Letsbay, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms and Conditions or your use of Letsbay's services.



12. Amendments to Terms

Letsbay reserves the right, at our sole discretion, to revise or replace these Terms at any time. The most current version of the Terms will govern our relationship with you and will always be available on the Letsbay website.



13. Account Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.



14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the courts of Kollam/Kochi, Kerala, and you irrevocably submit to the jurisdiction of such courts.



15. Miscellaneous Provisions

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

Automated technologies or interactions: As you interact with our application, we may automatically collect Technical Data about your device, such as IP address and device model, to ensure app functionality.

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:



Where we need to perform the contract we are about to enter into or have entered into with you (e.g., facilitating a rental).

You can initiate this request directly within the Letsbay app settings or by visiting our deletion request page on our website. Upon receiving a verified request, we will delete your personal information, except for data we are required to retain by law (such as transaction records for tax purposes) or for legitimate business purposes (such as fraud prevention).

12. Extended Policy for Mobile Application Permissions

This section specifically addresses the permissions and data access used by the Letsbay mobile application.

A. Device Permissions

Internet Access: We require internet access to connect with our servers, display listings, and process transactions.

Photos and Media: We do not request direct access to your device's storage or file system. When you choose to upload a photo for a listing, we use the system-provided Photo Picker. This ensures we only have access to the specific images you select to share with us, protecting your privacy.

B. Location Data

No Real-Time Tracking: We do not track your device's real-time GPS location. Any location information (such as pickup or delivery addresses) is manually entered by you for the purpose of the rental transaction.
